PRIVATE CERTIFICATE OF OCCUPANCY

 

• Application Form obtained by Applicant for N2,500.00 through Value Card.

• Application Form submitted with;

a. Survey Plans (3 Cloth & 1 paper)

b. Two (2) Passport Photographs

c. Land Information Certificate

d. Purchase Receipt of the Land duly stamped

e. Sketch map of the Site

f. Payment Receipt for Form, Publication and Capital Development Levy.

• Application published in daily Newspaper for objection purposes for mandatory 21 days.

• Application sent for 2nd Charting


• If no objection and back from Charting, Inspection of the Site by designated Land Officer/Rendition of Report.

• Processing of Certificate of Occupancy (C of O) through Executive Secretary to Honourable Attorney General and Commissioner for Justice.

• Execution of Certificate of Occupancy and Registration

• Certificate of Occupancy ready for collection at Collection Centre.

 

 GUIDELINES FOR ASSIGNMENT, SUBLEASE, MORTGAGE AND POWER OF ATTORNEY

 

• An application form should be made on Land form 1c obtainable in the Consent Section.

• The form should be completed with clarity to give all required information from the applicant.

• The form 1c should be dated and signed by both parties to the transaction.


• The completed application form should accompanied on submission with the following:

a) A certified True Copy of the Assignor’s (Donor’s title) document obtainable from the Lands Registry should be attached.

b) A Cheque (Bank Certified) made payable in LAGOS STATE GOVERNMENT for an amount equal to 71/2 %; 10%; 20% of the CONSIDERATION passing between the two parties should be attached as AN INITIAL DEPOSIT for Consent fee. It should be noted that after the property has been inspected and valued an amount equal to the CAPITAL VALUE could be demanded as consent fee. If the deposit does not cover the amount demanded then the balance could have to be paid before approval can be granted.

c) Current Tax Clearance Certificate of the two parties. In case of Mortgages only thee Mortgagor’s Tax Clearance is required.

d) Where one of the parties is a Limited Liability Company, the Internal Revenue Certificate of PAYE for its staff and current Tax Clearance Certificate for the Directors should be attached.

e) In case of a developed land, action will be facilitated if application is accompanied with the Building Plan of the property AND Tenement Rate Receipt.

f) In case of an undeveloped land, an affidavit in lieu of (e) above will suffice.

g) 6 (Six) copies of the Deed of which Consent is sought should be attached.

h) If the title of the property is fee simple interest the clause in the bracket should be entered in the Deed, (the Assignee herein mentioned hereby undertakes to pay all Government levies inclusive of Land Charges that may be imposed from time to time by the State Government).

• Where the land is a State Land or covered by a Certificate of Occupancy, evidence of payment of Ground Rent and Land Charges up to date should be produced.

• 99 Years term will be treated as ASSIGNMENT/TRANSFER

• N100.00 (One Hundred Naira) Economic Development Levy Receipt for the two parties.

• N7,500.00(Seven Thousand, Five Hundred Naira) for charging fee

• N1,500.00 (One Thousand, Five Hundred Naira) for Endorsement fee AND N1,500.00 (One Thousand, Five Hundred Naira) for Form 1c.

• Business Facilities 0.025% of the Mortgage Loan

• Evidence of submission of layout plans to Ministry of Physical Planning should accompany applications for Governors Consent on excised Villages/Settlement.

• Please note that all payments made for processing of Consent transactions are NON-REFUNDABLE.

• Admin. Charge- N3,000.00 (Cash)

RATIFICATION PROCEDURE

 

• Application Form obtained by Allottee for 2,500.00 through Value Card.

• Applicant submit the following documents for processing:

a) Two passport Photograph

b) Land Information Certificate

c) Photocopy of Purchase Receipt duly stamped

d) Current Special Development Levy

e) Current Tax Clearance Certificate

f) Sketch Map of Site Location

g) Original Survey Plan.

 

• Application forwarded to Permanent Secretary, Ministry of Physical Planning for Charting & Inspection.

• Report of the Inspection forwarded to Honourable Attorney General and Commissioner for Justice for approval.

• Application referred to Executive Secretary, LUAC through the Permanent Secretary [Lands] for further processing

• Applicants make payment for allocation

• Certificate of Occupancy prepared and sent for execution. It is thereafter handed over to Allottee after registration.

DIRECT ALLOCATION PROCEDURE

 

• Application Form obtained by Allottee for;

a. General Scheme - N2,500.00

b. Prime Scheme - N7,500.00

* Payment through Value Card

• Applicant submits the Form with the following documents;

a. 3 Years Tax Clearance Certificate

b. Two (2) Passport Photographs

c. Current Special Development Levy for the issuance of Acknowledgement Receipt.

• Applicant approach the Executive Secretary for availability of a Plot in the Scheme of Choice.

• Executive Secretary approves allocation of a plot subject to production of Bank Certified Cheques for the cost of Land.

• On receipt of Full payment for land, allottee is issued with Letter of Allocation.

• Certificate of Occupancy is processed thereafter and handed over to the allottee.
